Inside town limits: the Town of Herndon
The Town of Herndon's Building Inspections office issues permits for homes inside the town. The Town points out that the Virginia Uniform Statewide Building Code requires a permit before constructing, altering or demolishing a building, or installing or altering equipment the code regulates. It states that a building permit is required for all alterations, and that additions or alterations to electrical, plumbing or mechanical systems need separate permits. The Town asks that applications and plans be submitted by email. Read the Town's page directly: https://www.herndon-va.gov/departments/public-works/building-inspections/how-do-i-apply-for-a-permit.
Two other Town requirements are worth knowing. Contractors working in the town must meet the Town's business license requirements before applying for a permit, and outstanding Town property taxes and fees must be paid before a permit is applied for. Emergency permits, such as for water or electrical service, can be applied for before those finance requirements are met.
Outside town limits: Fairfax County
A Herndon mailing address does not by itself mean a home is inside the Town. If yours is outside town limits, Fairfax County's Land Development Services handles permits. The county lists bathroom remodels under interior alterations that need a permit, along with new, repaired or relocated plumbing fixtures. It lists replacing a bathroom vanity or countertop, replacing tile or flooring, and painting among work that does not need a county permit (https://www.fairfaxcounty.gov/landdevelopment/when-permit-required). Your real estate tax bill or the Town can confirm which side of the line you are on.
What usually triggers permits in a bathroom remodel
- Moving or adding a drain, toilet, shower valve or supply lines (plumbing)
- New circuits, relocated lights or outlets, a heated floor (electrical)
- A new or rerouted exhaust fan duct (mechanical)
- Framing changes, such as moving a wall or widening a doorway
We confirm the requirements for your specific scope rather than assuming. We do not publish permit fees or review times; the Town and the county set and post those.
Herndon's historic district
Parts of Herndon are in the Town's Historic District Overlay. There, the Historic District Review Board reviews exterior changes, and most exterior changes need a Certificate of Appropriateness before work begins (https://www.herndon-va.gov/departments/community-development/historic-preservation/historic-district-faqs). A bathroom remodel is mostly interior, but a new exterior vent cap or a replaced bathroom window is an exterior change. If your home is in the district, check with the Town before planning those.
HOAs and condo associations
Many Herndon townhouses and condominiums belong to associations. Interior bathroom work rarely needs association approval, but these can fall under association rules:
- A dumpster or storage container in a shared parking area
- Contractor parking and work hours
- A new exterior vent cap
- In condominiums, plumbing changes that touch shared walls, floors or risers
Rules vary by community, so check your governing documents or call your management company before work starts.
